Participation is limited to individuals who record content only in spaces they own or have full legal authority to use.

2. Program Availability and No Guarantee of Participation

Submitting an application does not guarantee acceptance, participation, or compensation.

Cuesta may open, delay, modify, suspend, or discontinue programs at any time, including before accepting any applicants. We make no guarantees regarding:

• When any program will begin or end
• Whether a program will be offered in your region
• The volume of footage that may be accepted
• The availability, duration, or amount of compensation

3. Application Information and IP Address Collection

When you apply, we may collect certain information, including your name, email address, availability, and IP address.

Your IP address is collected solely to determine geographic interest and demand for Cuesta programs. It is not used for identity verification, tracking across services, or advertising purposes.

4. Recording Rules and Participant Responsibilities

By using the Service, you agree that you will:

• Record only in your own private space or a space you are legally authorized to use
• Inform household members when recording may occur
• Never record visitors or third parties without their explicit consent
• Avoid recording minors, sensitive personal information, or restricted areas
• Follow all recording guidelines and safety instructions provided by Cuesta

You are solely responsible for ensuring that your recordings comply with all applicable laws, regulations, and consent requirements.

5. Content Ownership and License Grant

You retain ownership of the content you record and upload.

By uploading content to Cuesta, you grant us a non-exclusive, worldwide, royalty-free, perpetual, and sublicensable license to:

• Review, process, store, and analyze the content
• Edit, modify, anonymize, or transform the content
• Create derivative works
• Use the content for research, product development, model training, quality assurance, and commercial purposes

This license survives termination of your access for any content already submitted.

6. Content Review and Acceptance

All submitted content is subject to review.

Cuesta may accept, reject, limit, or remove content at its sole discretion, including for reasons related to quality, safety, privacy, technical requirements, or guideline compliance.

Only accepted content is eligible for compensation.

7. Compensation and Payouts

If compensation is offered, it may be based on factors such as:

• Duration of recorded footage
• Upload consistency
• Technical and qualitative standards
• Program-specific criteria

Rates are not guaranteed, may vary by participant, and may change at any time.

Payouts are processed monthly for accepted content only, subject to successful review and receipt of valid payment details. Cuesta is not responsible for delays caused by third-party payment providers or inaccurate information provided by you.

Cuesta reserves the right to withhold, adjust, or reverse payouts in cases of fraud, guideline violations, errors, or misuse of the Service.

8. AI-Assisted Privacy Protection

Cuesta may use automated systems to help detect and blur sensitive information in submitted content. These systems are intended as an additional layer of protection and are not guaranteed to identify or remove all sensitive material.

You are responsible for reviewing and deleting any footage you do not wish to submit prior to upload.

9. Voluntary Participation and Termination

Your participation in Cuesta programs is voluntary. You may stop recording or uploading content at any time.

Cuesta may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, applicable guidelines, or pose a risk to the platform, other participants, or third parties.

10. No Employment or Agency Relationship

Your use of the Service does not create an employment, contractor, partnership, or agency relationship between you and Cuesta.

You are not entitled to employee benefits, minimum compensation guarantees, or continued access to any program.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available." Cuesta makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or availability of programs or compensation.

12. Limitation of Liability

To the maximum extent permitted by law, Cuesta will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Service or participation in any program.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after any changes become effective constitutes your acceptance of the revised Terms.
